Leadrevives is a communication and automation platform that facilitates SMS messaging between businesses and their customers or leads. The Service enables automated and manual text message follow-up, callback requests, and re-engagement where there is consent, an existing business relationship, or a legitimate business purpose—such as responding to inquiries, following up on missed calls, confirming appointments, or maintaining customer relationships.

User Responsibilities

By using the Service, you agree to comply with all applicable laws, regulations, and SMS carrier requirements, including but not limited to the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and carrier messaging policies. Specifically, you agree to:

• Provide accurate and complete information when using the Service
• Obtain proper consent before sending SMS messages to recipients
• Only send messages where there is consent, an existing business relationship, or a legitimate business purpose
• Include clear opt-out instructions in all messages
• Honor opt-out requests immediately and automatically
• Maintain records of consent and customer interactions
• Comply with all applicable federal, state, and local laws governing SMS communication
• Ensure all messages sent through the Service are truthful, non-deceptive, and lawful

Important: You are solely responsible for ensuring your use of the Service complies with all applicable laws and regulations. Leadrevives provides the platform but does not control the content of messages sent by users.

SMS Communication Terms

By providing your phone number through website forms, callback requests, or direct inquiries, you consent to receive SMS messages from Leadrevives or from businesses using our platform. These messages may be automated or manually sent and are related to your inquiry, prior interaction, or existing business relationship.

Message Frequency: Message frequency varies based on your inquiry and the business's follow-up practices.

Rates: Message and data rates may apply based on your mobile carrier's plan. Please contact your carrier for details.

Opt-Out: You may opt out of receiving messages at any time by replying STOP to any message. All opt-out requests are processed immediately and automatically.

Help: You may reply HELP to any message for assistance or contact information.

Prohibited Uses

You may not use the Service in any manner that violates applicable laws, regulations, or SMS carrier requirements. Specifically, the following activities are strictly prohibited:

• Sending messages that violate the TCPA, CAN-SPAM Act, or other applicable laws
• Sending messages without proper consent, existing business relationship, or legitimate business purpose
• Using purchased, rented, scraped, or third-party lead lists
• Sending spam, phishing attempts, or fraudulent messages
• Harassing, threatening, or abusing recipients
• Impersonating any person, business, or entity
• Sending deceptive, misleading, or false information
• Engaging in illegal activities or promoting illegal goods or services
• Interfering with, disrupting, or attempting to gain unauthorized access to the Service
• Violating SMS carrier policies or industry best practices
• Failing to honor opt-out requests or continuing to message recipients who have opted out

Leadrevives reserves the right to suspend or terminate access to the Service for any user who violates these Terms or engages in prohibited activities.

Compliance Monitoring

Leadrevives actively monitors usage of the Service to ensure compliance with applicable laws, regulations, and SMS carrier requirements. We reserve the right to review message content, investigate complaints, and take appropriate action—including suspension or termination of Service access—for users who violate these Terms or engage in non-compliant messaging practices.

Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by law, Leadrevives, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising from:

• Your access to or use of (or inability to access or use) the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content
• Violations of applicable laws or regulations by users of the Service

You acknowledge and agree that you are solely responsible for your use of the Service and for ensuring compliance with all applicable laws and regulations.

Indemnification

You agree to indemnify, defend, and hold harmless Leadrevives, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any applicable laws or regulations, including but not limited to SMS carrier policies and telecommunications laws.

Service Modifications and Termination

Leadrevives reserves the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice, for any reason. We may also terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

• Violation of these Terms
• Non-compliance with applicable laws or regulations
• Engagement in prohibited activities
• Receipt of complaints from recipients or SMS carriers
• Suspected fraudulent, abusive, or illegal activity

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of material changes by posting the updated Terms on our website with a revised "Last Updated" date. Your continued use of the Service after such changes constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must discontinue use of the Service.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Leadrevives operates, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid, illegal, or unenforceable provision shall be replaced with a valid, legal, and enforceable provision that most closely reflects the original intent.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Leadrevives regarding the use of the Service and supersede all prior or contemporaneous understandings and agreements, whether written or oral, regarding such subject matter.
